PROVISION OF SERVICES TO CHILDREN

In carrying out our activities, there is a real possibility for us to process personal data of children in the mediation of real estate transactions that are owned by children or that will be acquired by children.

When a child purchases real estate, the child must be represented at the transaction by one of his or her legal representatives - parents, guardian or custodian. It is necessary to certify the relationship between the child and the parents. It is possible for a parent, acting on behalf of his or her child, to grant a power of attorney to a third party, whereby the property purchased becomes the property of the child. It is also necessary to prove the origin of the funds with which the property is to be purchased and, if the funds are on deposit in a bank in the child's name, prior permission from the court is required to withdraw the funds.

According to Art. 130, par. 3 of the Family Code, acts of disposal of immovable property owned by a child shall be allowed with the permission of the district court of his/her current address, if the disposal is not contrary to the child's interest. For this purpose, an application is filed by the parent on behalf of the child and the court assesses whether the sale (or exchange) is necessary and in the best interests of the child. The child's need and benefit from the sale must be substantiated, not the parents' benefit. Before making a judgment, the court may require an opinion from the Social Welfare Department of the child's home address as to whether the request is beneficial to the child and in the child's best interests, and may require additional documents from the parents, such as income statements, etc. It is only after the court has issued a judgment granting the application that the transaction itself can proceed.

When we need to process a child's personal data, we always ask for explicit consent to process the data from the child (if over 14) and from their legal representatives (parents or guardians).

It is good to know that even after you remove your account or if you have requested deletion of your data, copies of certain information from your account may remain visible in certain circumstances, for example, if you have shared information with social media or other services, or where the retention of such copies is necessary to comply with legal obligations or for legal protection.
